Droit à la protection de la santé et lutte contre la fausse information sur internet en période pandemique

Abstract

L’actualité relative à la pandémie de la Covid-19 avait envahi la toile via les différents médias et réseaux sociaux. À la suite de la peur  grandissante due au virus ultra-contagieux et surtout à l’absence d’un traitement approprié, les utilisateurs d’Internet étaient tous exposés à une avalanche d’informations contradictoires, trompeuses et fausses diffusées en toute liberté d’expression. À tout prendre,  certaines présentaient un danger imminent et grave pour la santé tant publique qu’individuelle et constituaient une désinformation ou  mésinformation sanitaire. Cet article démontre que si la liberté de communiquer ou de recevoir les informations ou les idées sur Internet  est cruciale dans une société démocratique, le droit à la protection de la santé nécessite que la société reçoive une bonne et  vraie information afin de préserver l’individu de tous les risques possibles que présente une information fausse ou trompeuse sur la
santé humaine dans un contexte de crise sanitaire telle qu’une pandémie. La liberté d’opinion et d’expression va de pair avec la santé  publique

English title: Right to health protection and fight against false information on the internet in pandemic period

News relating to the Covid-19 pandemic had invaded the web via the various media and social networks. As a result of the growing fear  due to the ultra-contagious virus and especially the lack of appropriate treatment, Internet users were all exposed to an avalanche of  contradictory, misleading and false information freely disseminated expression. All in all, some presented an imminent and serious  danger to both public and individual health and constituted disinformation or health misinformation. This article demonstrates that while  the freedom to communicate or receive information or ideas on the Internet is crucial in a democratic society, the right to the  protection of health requires that society receive good and true information in order to preserve the individual of all the possible risks  presented by false or misleading information on human health in the context of a health crisis such as a pandemic. Freedom of opinion  and expression goes hand in hand with public health.
