Abstract

Selon que le droit soit posé ou naturel, il apparaît face à la problématique des droits de l‟homme des défis démocratiques pour nos sociétés modernes, complexes par leurs structures et leur organisation. Dans un tel contexte, l‟accointance entre droit naturel et droit positif laisse émerger la question des droits de l‟homme considérés comme l‟émanation du droit naturel, qui se trouvent ensuite consacrés par des systèmes de droit positif. La consécration des droits de l‟homme par des systèmes de droit positif laisse transparaître des apories. Des décalages institutionnels qui nécessitent de ce point de vue une réflexion rigoureuse à partir de nouvelles perspectives qui s‟appréhenderaient sous l‟angle du monde vécu. Le droit procédural apparaît alors comme un outil essentiel pour une démarche compréhensive, inclusive et réelle des droits de l‟homme sous l‟agir communicationnel.

English Abstract According the law being settled or natural, it appears face the problematic the human rights, the democratic defies for our modern‟s societies, complexes by their structures and their organization. In this context, the cohabitation between natural law and positive law, leave emerge the question of the human rights considered by the systems of positive law. The consecration the human rights by the systems of positive law leave transpear the problems. This problem causes the crumbling the functions of protection and guaranty the law witch consecrated for human genus in fact that the preservation of his dignity. The institutional shifts who require in fact that the rigorous reflexion by the news perspectives witch would be apprehended under living world. The procedural law appears so like an essential tool for step comprehensive, inclusiveand real the human rights under the communicational act.
