La problematique du teletravail dans la legislation algerienne comme modele moderne d’organisation du travail pendant la pandemie de COVID19

Abstract

Cette étude aborde l’aspect juridique du télétravail en Algérie comme moyen moderne d’organisation du travail qui permet au travailleur d’exercer son activité, en dehors du lieu de travail, en utilisant les technologies de l’information et de la communication (TIC), en particulier à la lumière de la crise sanitaire actuelle (COVID19). Ce travail vise aussi à déterminer l’avenir de ce nouveau mode de travail dans l’ère post-pandémie et les défis auxquels il peut faire face en raison de lacunes législatives en matière du travail à distance, en Algérie, pour protéger le travailleur et assurer sa sécurité, dans l’exercice de son travail, tout en assurant les intérêts de l’institution qui l’emploie.

English title: The problem of telework in Algerian legislation as a modern model of work organization during the COVID19 pandemic

This study addresses the legal aspect of telework in Algeria as a modern means of organizing work that allows the worker to carry out his activity, outside the workplace, using information and communication technologies (ICTs), especially in light of the current health crisis (COVID19). This work also aims to determine the future of this new way of working in the post-pandemic era and the challenges it may face due to legislative shortcomings in remote work in Algeria to protect the worker and ensure his safety in the performance of his work, while ensuring the interests of the institution that employs him.
