The United Nations Security Council Targeted Sanction and Its Impact on Economic, Social and Cultural Rights
Abstract
The Security Council has imposed a number of sanctions on targeted individuals and states. These days it has preferred targeted sanctions to the general ones. These targeted financial sanctions and travel bans were also imposed on the families of the targeted and designated individuals. This article focuses on the impact of the smart or designer sanctions on the economic, social and cultural rights of targeted individuals and their families. It discusses the legality of these measures taken against the targeted individuals and their respective family members. The substantive human rights of targeted individuals and their families, inter alia, the right to property, health, work, and the right to education of targeted individuals and their families can be violated. Because of the absence of procedural guarantees in the areatargeted individuals cannot defend themselves against the Security Council’s action. The author will discuss how these procedural and substantive human rights are violated and the related issue of the right to effective remedies.
