A Policy Analysis of the Refugee Act 130 of 1998
Abstract
This article provides a policy analysis of the Refugee Act 130 of 1998,
focusing specifi cally on formulation and implementation. The South African legislation on refugees is located within the context of the principles of the Southern African Development Community (SADC), the African Union (AU), the New Economic Partnership for Development (NEPAD), the Constitution of South Africa and international conventions to which the South African government is a signatory. The South African government has laboured under severe criticism from the international community for its practices regarding refugees and asylum seekers. This article explores some of these criticisms and their infl uence in shaping current legislation.
